The law is clear: holding or using a phone, sat nav, tablet, “or any other device that can send or receive data” while you’re driving is illegal. That’s still true if you’re queuing in traffic, have stopped at lights, are sitting behind the wheel of a car that shuts down its engine while stopped, or supervising a learner.
There are a few exceptions, like when you’re safely parked or you need to call emergency services and stopping would be unsafe or impractical – but, in general, what you can do with devices while driving is extremely limited. The penalties are significant, starting at six points and a £200 fine, rising to £1,000 and a driving ban.
